These Terms and Conditions (“Terms”) constitute a legally binding agreement between Raceomania Sports Private Limited, a company incorporated under the applicable laws of India, having its registered office at Unit No. 512, Fifth Floor, OCUS Quantum, Samaspur, Sector-45, Gurgaon - 122003, Haryana, India (“Company”, “we”, “our”, or “us”), and any individual or entity (“Participant”, “you”, or “your”) registering for, purchasing tickets to, or participating in our functional fitness and obstacle race events (“Event(s)”).
By registering for or participating in any Event, or by using our website or related digital platforms, you expressly agree to be bound by these Terms and Conditions, including any additional event specific rules, instructions, or policies issued by us from time to time.
If you do not agree to these Terms, you must not participate in any Event or use our services.
If you register on behalf of others (e.g., a team etc), you confirm you are authorized to accept these Terms for each participant and shall share all relevant event communications with them. Additional rules may apply for categories or venues; event-day instructions will prevail for safety.
For the purposes of these Terms, unless the context otherwise requires:
“Event” means any fitness, endurance, or sports competition organized or facilitated by the Company, including all ancillary activities, warm-up sessions, briefings, and ceremonies.
“Force Majeure Event” shall mean any event beyond the reasonable control of the Company, including but not limited to natural disasters, adverse weather, fire, flood, earthquake, war, civil unrest, strikes, governmental action, epidemic, pandemic, or power outage.
“Participant” shall mean any person who registers, purchases a ticket, or takes part in an Event, whether individually or as part of a team.
Eligibility & Registration Participation is open to individuals who meet the eligibility criteria specified for each Event. Participants must be eighteen (18) years of age or older on the date of registration.
Minors shall be permitted to participate in the Event solely upon submission of a duly executed written consent and indemnity declaration from their parent or lawful guardian, in such form as may be prescribed by the Company. The parent or guardian providing such consent shall be deemed to have accepted these Terms and Conditions on behalf of the minor and shall be jointly and severally liable with the minor for the full and faithful performance, observance, and compliance of all obligations, representations, warranties, and undertakings contained.
The Participant represents that all information provided during registration is true, complete, and accurate. The Company reserves the right to cancel or reject any registration if any information is found to be false or misleading.
Registrations are subject to availability and the Company reserves the right to refuse entry or limit participation for reasons of safety, capacity, or regulatory compliance.
Any change in participant details, category, or transfer of registration shall be subject to the Company’s written approval and applicable administrative charges.
The Participant hereby represents, warrants, and affirms that they are medically, physically, and mentally fit to undertake and participate in the Event and have obtained such medical examination, fitness certification, or clearance as may be reasonably required to confirm such fitness, and that they shall immediately disclose to the Company or its authorized representatives any pre-existing medical condition, illness, injury, or other circumstance that may in any manner affect or impede their safe participation; and the Participant further acknowledges, accepts, and voluntarily assumes that participation in the Event necessarily involves strenuous physical exertion and carries inherent risks, whether arising from their own acts or omissions or those of other participants, third parties, or environmental conditions which are beyond the control of the Company. Accordingly, the Participant expressly agrees that all such risks shall be borne solely and entirely by the Participant, who shall participate at their own cost and risk, and hereby irrevocably waives, releases, and discharges the Company, its partners, employees, agents, contractors, and affiliates from any and all claims, demands, losses, damages, or liabilities of any nature whatsoever arising out of or in connection with any injury etc sustained during or as a consequence of participation in the Event, The Company shall further have the absolute right, at its sole discretion and without incurring any liability whatsoever, to refuse, restrict, suspend, or terminate the Participant’s entry or continued participation in the Event if, in the Company’s reasonable opinion, such participation poses or may pose a risk to the safety, health, or wellbeing of the Participant or any other person.
The Participant shall, throughout their participation in the Event, conduct themselves in a lawful, disciplined, responsible, courteous, and sportsmanlike manner, strictly complying with all rules, regulations, codes of conduct, safety protocols, signage, announcements, and lawful directions issued by the Company, its event staff, officials, marshals, security personnel, or law enforcement authorities, and shall refrain from engaging in any act or omission constituting harassment, abuse, misconduct, use or possession of performance-enhancing or prohibited substances, or any behaviour which, in the reasonable opinion of the Company or its authorized representatives, is dangerous, disruptive, unsportsmanlike, or otherwise detrimental to the safety, wellbeing, or experience of other participants, officials, or spectators; and it is hereby expressly agreed and acknowledged that any breach of the foregoing obligations shall constitute sufficient cause for the Company to forthwith disqualify, exclude, or remove the Participant from the Event venue without refund or compensation of any nature whatsoever, without prejudice to the Company’s right to pursue such further legal remedies as may be available under applicable law.
The Participant acknowledges and agrees that all registration fees and related charges applicable to participation in the Event shall be determined by the Company at its sole and absolute discretion, and that such fees may vary based on category, tier, promotional offer, or other pricing criteria as may be prescribed from time to time.
That all applicable taxes, levies, payment gateway charges, and platform or service fees shall be borne solely by the Participant and, once paid, shall be strictly non-refundable where mandated by applicable law.
The Participant expressly acknowledges and agrees that all registrations, once completed and confirmed, shall be strictly non-refundable and non-cancellable, save and except where a refund is expressly mandated under applicable law, and in the Booking & Cancellation Policy and that in the event of a postponement of the Event for any reason whatsoever, the Participant’s registration and entry shall automatically stand transferred and deemed valid for the rescheduled date of the Event without any additional consideration or refund.
That in case of a cancellation of the Event, the Company may, at its sole and absolute discretion and without incurring any obligation to make monetary refunds, offer participation credits, alternative event entries, or such other compensatory options as it may deem fit.
That any request by the Participant for transfer, substitution, or deferral of registration shall be subject to the applicable deadlines, availability, and payment of such administrative or processing fees as may be prescribed by the Company from time to time.
That all third-party platform fees, payment gateway charges, and ancillary processing costs are incurred at the Participant’s sole expense and shall, under no circumstances, be refundable or recoverable from the Company.
That any discount codes, vouchers, or promotional offers are personal to the Participant, non-transferable, subject to such terms and limitations of use as may be specified by the Company, and shall not be combined or clubbed with any other offer unless expressly authorized in writing by the Company.
That the assigned credentials, or other participant identifiers shall be personal and non-transferable, and any substitution, sale, or transfer thereof without the Company’s prior written consent shall be void and render the Participant liable to disqualification and/or any request for deferral, substitution, or transfer of registration may, at the Company’s sole discretion, be permitted subject to applicable administrative deadlines, availability, and payment of such processing fees as may be prescribed from time to time.
We may alter course elements, distances, start times, or logistics for safety, weather, government orders, power outages, indoor space availability, or other Force Majeure events. Our liability is limited to remedies expressly provided in these Terms or event-specific policies.
Unofficial results may be posted promptly; official results are subject to verification and may take additional time. Timing disputes must be submitted within 24 hours of provisional publication. We reserve the right to correct errors, disqualify participants for rule violations, or adjust categories. All Awards are conditional upon verification and compliance with these Terms and/or policies of the event.
By participating, you consent to the worldwide, royalty-free use of your image, likeness, voice, and event data for results, news, and promotional purposes. Content tagged with official handles may be shared. You confirm that you have read and understood our Privacy Policy. Requests for removal from marketing materials must include your name, bib number, and event details.
BIB/bands must always be visible. Damaged or tampered credentials may be invalidated. Re-entry policies vary by venue. We may refuse or revoke entry to ensure safety or comply with laws.
The following items and activities (including but not limited to) are strictly prohibited on the premises: weapons, fireworks, illegal substances, outside alcohol, drones, glass containers, unapproved recording devices, and any advertising materials within workout zones. Only authorized service animals are permitted, in accordance with venue policies. Any commercial activities, filming, or photography require prior written authorization from the Company.
To the fullest extent permitted by law, we shall not be liable to participants for any indirect, incidental, special, consequential, or punitive damages including loss of property. Our total liability to any Participant shall not exceed the amount of Participants event entry fee. Participants agree to indemnify, defend and hold harmless us and our partners, affiliates and representatives from and against any claims, liabilities or expense arising from participant’ s breach of these Terms or negligent acts.
All intellectual property rights, including but not limited to trademarks, service marks, logos, course designs, text, graphics, images, audio, video, and other media (collectively, 'Content'), are the sole and exclusive property of the Company. Participants and third parties are strictly prohibited from using, reproducing, distributing, publicly displaying, performing, or creating derivative works from the Content without the Company’s prior written consent. Any unauthorized use may constitute an infringement of copyright, trademark, or other intellectual property rights under applicable law, and the Company reserves all rights to pursue legal remedies against the violator.
Participants acknowledge and agree that any use of integrated or linked third party services, including but not limited to payment processors, photography platforms, analytics tools, or other external services (collectively, 'Third Party Services'), is subject solely to the terms, conditions, and privacy policies of such third parties. The Company makes no representations or warranties regarding Third Party Services and shall not be liable for any loss, damage, or dispute arising from a participant’s use of them. Participants assume all risk and responsibility for compliance with the applicable terms of any Third Party Services."
Your personal data is handled per our Privacy Policy. Registration indicates consent to necessary processing for event operations, safety, and communications.
We may contact you by email, SMS, Whatsapp or phone about registrations, logistics, results, or marketing. Marketing communications can be opted out of anytime; operational messages are mandatory for participation.
These Terms shall be governed by and construed in accordance with the laws of Gurugram, Haryana courts without regard to conflict-of-law principles. Any disputes, claim or controversy arising out of or in connection with these Terms or polices of the events shall be subject to exclusive jurisdiction of the courts in Gurugram, Haryana . The Parties agree to first attempt in good faith to resolve any dispute amicably, including through mediation, prior to initiating litigation
The Company reserves the right to modify, amend, or update these Terms at any time without prior notice. Any such amendments shall take effect upon publication on the Company’s official website. Continued participation in an Event following any modification constitutes acceptance of the revised Terms.
